Brother Named As Defendant In Multi-car Crash That He Wasn’t In

Card image cap

Location: Oklahoma

A couple of years ago, my brother was driving home at night during the beginning of icy weather. He spun out and hit the center highway barrier and was the only vehicle involved. Oklahoma highway patrol arrived at the scene, wrote a report and sent him on his way as his vehicle was drivable.

Later that same night on a completely different highway there was a multicar pile up that caused massive damage and casualties. As it would appear, the same highway patrol officer responded to that accident and somehow incorrectly named my brother as the driver who caused the crash.

This was something that my brother was unaware of until late last year when he was named as the defendant in a case with numerous plaintiffs who were involved in that crash, including the family of the decedent. At the time, my brother contacted his insurance company who had the report of his accident from earlier in the night, and they assured him not to worry, and that their legal team would look into it. He believed that the issue had gone away, but now he has been served again as there have been more plaintiffs added to the case.

He is a 22-year-old kitchen manager and cannot afford a lawyer. Is this something that can be resolved without him retaining council or is that the correct route for him to attempt? He has attempted to contact Oklahoma Highway patrol to connect with the officer who incorrectly listed him as the cause of this accident to no avail.

Edit: I believe my timeline was incorrect, this occurred in 2024 and he was served months later in 2025. He has now been served again this week.
