Can An Assisted Living Facility Unilaterally Require That A Temporary Resident Remain In The Facility?

A few months ago my neighbor, an elderly woman, fell and broke several bones. After a few days in the hospital she was sent to a rehabilitation center where they gradually got her standing and then walking again. She made plans to move back home this month and one of her relatives has moved into the house to help her once she does.

However, this week the facility told her they would not allow her to leave and she would have to stay for another month. They say she is not ready to live on her own, and they do not take any notice of the fact that she has an able-bodied relative living in her house able to assist her there.

  • Her physical capabilities are about what they were before she fell
  • She probably should not be living on her own, but she has a relative already living in her house and able to assist her
  • She is NOT happy at the assisted living facility and wants to move home, but was TOLD that she couldn't

Is this something that an assisted living facility is even allowed to do? She is paying full price out of her own pocket to live in this assisted living facility, no "insurance rate" or "Medicare rate", and I get the impression that that is a large part of why they want to keep her.
