Can I Sue After The Towing Company Wrongfully Towed My Vehicle Overnight In Ny?
Location: New York
My vehicle was wrongfully towed in the middle of the night by a towing company that claimed it was parked in a fire hazard zone, although it was not. The towing company later admitted there was no reason for the tow, and the apartment building management confirmed the same. As a result, I missed work. When I contacted the towing company to retrieve a towing report for my employer, they told me to get it from my local police precinct. However, the precinct informed me that they do not issue towing reports and that such documentation should come from the towing company. Upon returning to the towing company, they claimed they shredded the report to "keep me safe" and stated that the apartment management had paid for the tow, which I believe is false as there was no towing bill initially. The owner then proceeded to verbally assault me when I calmly requested the report again. He said he would “draw something up for me” and when I told him I would be expecting to receive that in two business days he began to yell again and tell me I could deal with his lawyer. I then asked for the lawyer’s information and was denied for “safety purposes”. The car was towed overnight, and I have recordings of my conversations with the towing company and apartment management. I also believe my car was damaged in the process of being towed. Can I pursue legal action?
