Can My Ex Use Gifts From My New Wife To Increase Child Support?

Card image cap

My ex filed for a child support increase and her lawyer sent me discovery. I don’t have an issue being transparent about my finances. I’m willing to disclose my income and I already spend a lot on my kids outside of child support.

The issue is that my current wife makes good money. She doesn’t pay my bills, but she has given me gifts and occasional money. It’s not routine support, just gifts here and there.

Two things in the discovery bother me:

  1. They want me to list all gifts over $500 that I’ve received. Is it reasonable to object to that?
  2. They’re also asking for any financial statements I prepared or had prepared related to a house I recently purchased. I’m uncomfortable with that because my wife gifted me the down payment and they will subpoena the record.

I don’t want my wife dragged into this or treated as if she should be helping fund child support for kids she didn’t have. She already spends a lot on them voluntarily with gifts, trips, and restaurants, which their biological mother (who is also financially well off) never does.

I’m trying to figure out what’s reasonable to push back on here and what courts usually allow in situations like this. Location: TX

Thanks guys,
