Can The Dealership Sue Me?

Location: Indiana, U.S.

Purchased a car from a dealership. Planned to finance through them, a buy-here pay-here type place.

Somehow they let us drive off without signing the financing paperwork. Guy forgot to print it, we signed all other documents, just not the financing.

Had paid $300 of a down payment, the remaining $1,700 was kindly deferred.

Upon realizing their mistake they panicked and tried to get us to come in to sign financing immediately. We looked over the contract they sent us, and as we were no longer in a high pressure situation, realized the loan terms were TERRIBLE.

They tried to get us to sign over power of attorney so they could sign for financing on our behalf. Sketch.

I checked with my credit union, was surprisingly able to get financed for way better terms and the dealership received their money. The credit union asked for a bill of sale from the dealership, the bill of sale noted our trade in and downpayment at 2,000. Credit Union pushed our loan through based on that document.

Today, after they’ve already received their money, financing is done, they send a new adjusted bill of sale- noting the $1,700 is still due for the down payment.

We bought the car for approx $27,000

Got financed through the bank and they received approx 30,000.

I can’t find any paperwork stating we still owe them the downpayment. My understanding was that we pay the downpayment because they were providing financing, but that’s no longer the case. They’re harassing us and haven’t provided anything other than an updated bill of sale. What do I need to do?
