Can This Be Considered Defamation?

Card image cap

One of my relatives is in an ongoing investigation, however, someone has written an article about the situation but it is specifically painting my family member as the sole perpetrator in the case. There are two parties involved as perpetrators at the moment, the other person wasn't mentioned in as much detail and my family member is not the sole perpetrator in the case filings either. They haven't been able to determine who is or if they're both equally at fault.

This person seems to come after my family member specifically because they are in the military.

However, there have been no convictions.

No preliminary hearing. The writer did add the upcoming court dates in the article as well.

Only the charges they were arrested on.

Once the investigation is over IF the charges are dropped can the author of the article be sued for defamation if they do not update the article to reflect charges being dropped. While the charges do show up right now when you search for this relative, there have been no convictions.

I did see on Google (not the most trustworthy) that if someone is falsely accusing you of serious criminal charges (these are felony charges) that it can be seen as damages/harm because of the inherent damage it can do

I know their best bet is to consult a lawyer

I'm just curious on this is all!

Any suggestions or advice is welcome :)

Thank you!
