Workers Comp
Location: Florida
To make a long story short, I was injured at work when a coworker accidentally hit me in the head with a metal drawer. I immediately reported the incident to my assistant manager, but he did not take the situation seriously. He did not ask if I was okay and instead questioned whether the injury was a valid reason for me to go home. The coworker involved laughed and told me not to sue because he “has no money.”
Due to severe head pain, I went to the hospital. No CT scan was performed, and I was advised to follow up through workers’ compensation. I then went to the doctor Publix directed me to. That doctor also did not order a CT scan and told me that under Florida law, my injury would only be taken seriously if I had visible swelling or bruising. However, since the day of the incident, I have continued to experience severe headaches as well as neck and shoulder pain. Along with face numbness and my right eye feeling heavy and appearing to be droopy.
The doctor informed me that my case will be closed on Tuesday. And if Publix wanted to fire me that they could.
Given these circumstances, I want to know whether I have a legitimate reason to file a lawsuit.
