Car Salesman Injury At Dealership… Who Covers This?
Location: Florida
While taking delivery of our car at the dealership the salesperson injured themselves while demonstrating the vehicle prior to us getting keys, financing -basically while we standing around drinking crappy coffee.
Salesperson has subsequently retained a PI attorney who has filed claims against both our homeowners and auto.
We dont want to discuss the details of our liability- which we beleive to be very low -but whose insurance may ultimately be covering this? Both our policies MAY be disputing that this is a covered event which is freaking us out.
Our understanding (entirely AI driven) is the salesperson was acting in a professional capacity at the dealership demonstrating the vehicle to a customer(us). They may have already filed workman’s comp (introduces exclusive redress for the dealership but leaves us with pain and suffering claim). We are hoping the dealerships liability insurance will have to defend/cover us -after a bunch of finger pointing- and our insurance will tender defense to the dealers insurance.
Can anyone tell us if this is a likely scenario for how this will unfold?
We are getting an attorney next week and this sucks.
