Co-executor Advice Contentious Step Mother
Location: Mississippi
My father is in Mississippi and married a woman about 10 years ago after my mother died of an extended illness. Maintaining a relationship with my dad has been an ordeal because she hates that I exist and hates that we have a good relationship.
When they first married, my father put all his estate in a living trust and made my stepmother and me co-decision-makers about his health if it declines and co-executors of his estate. And co-attorneys-in-fact with the ability to operate independently. If this were to work as it is supposed to, my stepmother would get the house. I get the '70s Porsche I learned to drive on and we split everything else down the middle.
This has always seemed like a terrible idea to me. For us to A) need to work together and B) having independent authority to act means either one of us can screw the other completely.
Some recent events have made my dad willing to name his attorney as the executor of his will. He didn't mention the attorney-in-fact. I'm reaching out to ask what else I should discuss with him. My biggest fear is fighting my stepmother while I'm mourning my dad.
