Copyright/trademark Infringement Claim?

Card image cap

I'm developing a game called "The Undergrowth" It's a PvP bug survival game, you play as a insect, my Steam page went live May 20th of 2026 the game that ripped me off was released October 28th 2026

My Game - Steam: https://store.steampowered.com/app/4762680/The_Undergrowth/?beta=0
(Posted to Steam May 2026)

Game copying mine: https://www.roblox.com/games/83661382686484/Undergrowth-Bug-Survival
(Posted to Roblox October 2026)

I contacted Roblox for a DMCA but does my case hold water? It's clearly a rip off of my game, same name, same genre, same play style etc. The game name is not trade marked though.

So I'm wondering if my claim is valid and If I should 100% pursue a full takedown or is it in a grey area since my title isn't released yet or trade marked?

Because if Roblox refuses to take it down since it isn't trade marked I'm just wondering if I have, or possibly have the legal authority to get it taken down outside of contacting Roblox themselves.

Any help or advice would be appreciated, thank you
