Could This Be Defamation?
Location: New York
Hello everyone. We recently had some ice damming on our house and called around for a company to fix it. My wife and I had concerns and posted a review. We weren’t happy to say the least, and feel the owner misled us about being able to do the whole job. I wanted a company to come out take care of the ice dams AND assess/take care of the damage. After we left the review the owner called and said he would sue us. I know a little bit about the definition of defamation and I am fairly confident the review is fact(what happened) and our opinions(that we wouldn’t have hired him if he was going to do what we considered half the job). I’m just nervous, and want to see what you guys think. Here is the review in question:
“We called about a leak in our living room ceiling due to ice. Crew came out quick and removed ice with sledgehammers. We expressed concern about this damaging the roof but were told by John it was the most effective way. After removing the ice, the crew expected payment ($400) and said they couldn't provide an estimate to fix the leak and we'd need to call John. John then told us they don't do that kind of work. We would not have agreed to let them come over if we knew they'd only do half the job! Now we're out $400 and still have an active leak. I would not recommend and I will not call this company again.”
Needless to say I am much more wary of contractors after this, we haven’t had to deal with contractors luckily with our house too much.
