Cps And Safety Obligations

CPS showed up at my friend’s home a few weeks ago because her ex-husband and his current wife got into a physical altercation with their minor child (9F) present, and the police were called. After the police left their home, her ex obtained a no-harass order against the wife. CPS explained they were at her house to make sure their kid had somewhere safe to live, and ask about their custody arrangements. She told her ex-husband that their child would not have overnight visits until the threat of violence was no longer present in his home and he agreed. Overnight visits are not in their official arrangement, but have been happening for about 3 years.

My friend recently found out that her ex went to court to remove the no-harass order and wants to resume overnight visits. I told her to be concerned about her potential liability with CPS if she agrees to resume and the police are called out for another fight there. If that happens, she can’t pretend she didn’t know what was going on in the home, and a CPS case could be opened against her for failure to protect her kid. Am I just being too cautious? What’s the most prudent course of action for her here? I hate that she’s been dragged into this bullshit that has nothing to do with her.
