Daycare Left Our Kid Wandering Around Outside

Our daycare somehow left our 2y/o child outside, and he was wandering around in traffic. The daycare lady was absolutely negligent about it, hid the situation from us, and we only found out several days later from CPS. She then lied to us about the situation, as evidenced by the fact that the state's investigation stated different facts from what she told us. Our child was super traumatized by the situation and has been having nightmares and sudden, severe separation anxiety. He does not want to go back to daycare.

We called a personal injury lawyer at a friend's suggestion and they said they couldn't help us, but we're really hoping we can somehow force the daycare to refund our deposit. We'd also like them to allow us to leave the center without penalty (we're supposed to give 30 days notice and they said they won't budge on that) as well as cover the costs for application/enrollment at another daycare, since we feel like this whole situation is their fault.

If hiring a lawyer isn't feasible, do you think this matter could be suitable for small claims?
