Dealing With Bad Insurance Adjuster. What Should I Do Next?

Card image cap

Location: Central Florida

On 8/30 I filled up at BJ's gas (similar to Costco) and the pumps were flowing extremely slow and the next day all of the lights turned on my dash.

The following day I broke down (car was sputtering and would no longer accelerate) and I had to get a tow home. I was unable to go to work the following day (9/2)

Before this the car had no issues (2020 Honda fit, 58k miles) and after seeing multiple posts on social media and calling a local mechanic it was obvious that BJ's had bad gas/water in the gas that day.

I called BJ's and filed a claim with them and heard from an insurance adjuster (Sedgwick) on 9/3. He said he hasn't gotten any response from the local BJ's yet. I called the local BJ's and they said they haven't gotten any calls from him. When I spoke to him on 9/4 he said he still hasn't heard from them. I called the local BJ's again and they said that they still haven't heard from him. I called back the adjuster and told him that and whenever I spoke to the local bjs again they said that they then got an email from him.

The weekend goes by and on Tuesday 9/8 he calls me and tells me that BJ's will cover the repairs and the tow to a mechanic and that they will set up a rental car reservation starting that day and for the next 7 days and that it can be extended if needed. When I go to enterprise that evening after work they tell me that I should get one day of the DW/CDW insurance since I don't have collision on my personal car insurance policy and that bj's should reimburse me for the one day I paid out of pocket since they should pay for it. The enterprise employee unfortunately didn't see that I in fact do have collision on my Honda fit, it's just terrible coverage ($2,500 deductible). The enterprise employee said that he called the adjuster to speak with him about it the next day.

On Wednesday 9/9 morning I had the car towed to the mechanic and later that day got the estimate. I sent the estimate and tow receipt to the adjuster Thursday morning. He calls me around lunch time and says that he is sending me a check that covers the estimate and the tow receipt.

While I was at work I realized how much trouble I'd be in if I were to get in an accident with the rental car without that full insurance. I left the adjuster a vm and told him that I need insurance covered on the rental car and if it wouldn't be covered then I would at least need a new reservation sent so I could pay for the coverage out of pocket. Because for some reason enterprise is unable to just add on the insurance after it was taken off already. The adjuster said that he will see what he can do and would get back to me the next day by noon (yesterday). I drove the rental car home and parked it and haven't used it since.

The adjuster of course didn't call me by noon, so I gave him a call after noon and he said "I was going to call you today! I am going to see what I can do" I let him know that I need a new reservation either way before the weekend, so I can use the rental car by Monday to go back to work. I told him of course it would be great if its a new reservation with the insurance covered 100%, but if not then I need a new reservation either way so I can pay for the insurance out of pocket. I sent him an email at 4:30 and called him again shortly before 5...no response.

This morning I called enterprise just to see if he possibly sent in new reservation without telling me, but he did not. Now I'm just not sure what I should do next. I really needed the rental car situation to be worked out before I have to be at work on Monday. This whole situation has cost me so much more than just a tow and car repair. I had the initial tow, I missed a day of work, and no (safe) transportation since 9/1 other than the one day I paid for the insurance out of pocket.

Sorry for the long post, I am just hoping someone can give me some advice. Is this something that I should call an attorney about, or just keeping dealing with this adjuster? Thanks.
