Default On Divorce Agreement - Any Recourse?
Location: New York
My ex and I divorced six years ago after 32 years of marriage. In our agreement he is required to maintain a life insurance policy for $100K with me as beneficiary. The court document states that he cannot borrow against it or cash it in. There were two whole life policies listed in the document, one of which I was the beneficiary. The document also states that I can request confirmation of the policy at any time. Up to this point I haven’t done so.
Recently I was advised that he has cashed in the policies and he plans to force me to sue his estate (our daughter is executor) when he dies in order to recover the proceeds that the life insurance was intended to cover.
What recourse do I have while he is still alive and can/will a court actually force him to comply? I have no problem making a claim against his estate upon death but I’m infuriated that he has disregarded a court order in our divorce while I continue to comply with my requirements (he gets 50% of my pension every month for life).
