District Attorney Won't Charge Her Friend With Abusing My Kid Location: New Mexico

This is a long story. TL;DR the city attorney who abused my kid had his charges dropped by the DA, who is a personal friend of his. Do I have any options to force the DA to recuse herself given her personal relationship with the defendant?

My son D had a stepfather, K, who is the assistant city attorney for where I live. In summer of 2023 I learned that K had been abusing D for years, mostly emotional, but occasionally physical. The last altercation happened when K threw D to the ground, choked him a bit, and gave him a black eye.

At that time D came to stay with me while his mama figured out what to do. After a few days of trying to talk to K about therapy she called the police when he threatened her with a sword. The police came...and did nothing. Didn't interview my kid, or me, or his younger brother that was in the room. Didn't report to CYFD. Just quietly killed the case. And I didn't follow up because I figured the important thing was that D was safe.

On 2.14.24 D took his own life. Years of abuse had fucked with his head. I should have seen the signs that he wasn't okay, but I didn't. And I live with that every day.

After D died I started investigating what happened to those child abuse charges against K. That's when I learned the police had killed the investigation. I spent 2.5 years fighting to get justice for my kid. Finally, in March of 2026 I was able to arrange a meeting with the new mayor of my city, and I told him my story. He was horrified and instructed the Deputy Chief who was also present to reopen the case. SVU detectives were assigned, and on 6.1.26 Child abuse in the 3rd degree charges were filed against K.

And then two days later the DA dropped the charges, claiming there was a lack of evidence. The DA is personal friends with K. He used to work under her before he moved to the City Attorney's office.

What are my options? Is there any way to force the DA to recuse herself, since she has a personal relationship with the defendant? I refuse to accept that this is the end. D was kind and smart and he deserved so much better.
