Do I Have The Right To Issue A Dmca Takedown Of Material That I Unintentionally Uploaded?
Location: Texas, US.
At the beginning of this year, I began using a program called ShareX to take screenshots of my desktop. Apparently, the program defaults to uploading your images to not only your local files, but imgur as well. I did not know this at all, nor does the program notify you of a third-party host upload. Unfortunately, I took lewd screenshots of myself with the intention of it being private but it was uploaded to imgur without my knowledge. As ShareX uploads anonymously, I can't outright delete them myself. I've made 2 separate requests for deletion to the website for all those images, but only some have been deleted (I'm assuming AI handles deletion, not a real person).
I've already typed up an official-looking draft to send to imgur's abuse email, but I assume perjury? is the consequence for a wrongful DMCA notification. The questions I have are:
Do I have a right to send a DMCA takedown? I mean, TECHNICALLY I was the one to upload it (through a program), but I want them taken off the site now.
If I do have the legal right, would I need to get a lawyer or go to court for this? Or will it just be a back-and-forth emails situation?
Do people even have ownership over screenshots? And if they do, how exactly can I prove my ownership of these screenshots?
If my actions fall through, could legal action be taken against me? I absolutely cannot afford any legal issues or fees.
Please help, the views are racking up on these images.
