Do I Have To Tell My Current Employer The Details Of My New Job? (california)
Location: California
So I am leaving my current job (long story short they won't allow me to relocate to live with my partner) and as part of the standard exit paperwork they sent me a copy of the "Restrictive Covenants" agreement I signed when I was hired. It's mostly standard "I won't steal trade secrets" stuff however there is also a non-compete agreement within the contract. Most of the provisions of the non-compete agreement I'm not concerned about, however there is a subsection that essentially states "for 12 months after termination I will notify the company of the name and address of any new employer and I will also provide the new employer with a copy of this agreement". The thing is I may or may not be going to work for a competitor and would rather not give that information to my old job.
My understanding is that non compete agreements are basically illegal in California and my preliminary research has indicated that if they attempt to go after me for not sharing with them the name of my new employer that could be seen as a form of unfair competition. With that being said I really can't afford an attorney right now and would love some guidance and peace of mind if someone knows this niche of California employment law.
