Does My Landlord Have To Allow A Reasonable Sublease For The Summer If I'm Not Ending My Lease After?
Location: Chicago, IL.
Multiple of my roommates are going abroad short-term (2-6 months) and are looking to sublet, but our landlord says that they will only accept subletters if the tenant is ending their own lease. My roommates are hoping to lease for that short time and then resume their own lease after. I know Chicago law generally says they have to accept reasonable subletters, but the wording of the actual RLTO section starts with the phrase "If the tenant terminates the rental agreement prior to its expiration date," so I'm unsure if we are still protected.
Landlord's exact words from email: "As mentioned previously to your roommate, subleasing may be considered in certain situations; however, it is intended for residents who plan to permanently move out of the unit and will not be returning. In those cases, the process would involve a full lease takeover by a new, approved tenant.
Unfortunately, short-term or temporary subleasing arrangements are not permitted under our leasing guidelines."
Are they required to let us sublet to a reasonable tenant?
