Dog Bite And Possible Lawsuit

Card image cap

Location: Colorado

In late May I was on my morning walk (old geezer) when I see a young girl walking a medium sized pit bull down the sidewalk heading towards me. She immediately moved to the center of the road as they got closer but unfortunately for me the dog then dragged her towards me until it got close enough to bite my hand as i tried to push it away and then bit me on the hip. I told the girl to grab her dog and not leave as I was calling the police which she complied with being she was next to her house. Told her mom she couldn't stop the dog and mom just looked at me and said she couldn't handle confrontation and took the dog and daughter into the house. Police arrived took photos of the bites told me to go get them looked at which I then went to the emergency room. Two hours in ER ex rays of fingers that got bit and what felt like gasoline being pumped into the puncture wounds on my hip, no stitches for dog bites fearing infection.

The daughter was walking the PB with a cheap retractable leash no muzzle or any bite prevention at all, and come to find out the same daughter was walking the dog when it attacked my neighbor who was lucky enough to escape with just torn pants but did file a police report. Parents have never apologized or asked if I needed anything. I'm really not doing for the money my main goal is to get rid of the PB and make our neighborhood safe again.

So my question is should I file a negligence lawsuit against these people? Facts are the mother told the officer who responded that the dog is a rescue that was abused and I quote "Likes to go after certain people" this is on the police report. Is it worth the hassle? I don't think my bites constituents the level to go after damages but I think it does qualify for negligence and I just really want to get rid of the dog and teach these clowns you don't get a rescue PB unless you know how to safely train it.

Thanks for the time
