Drunk Driver Destroyed Garage, Insurance Wanting Us To Sign A Settlement Covering Only 30% Of The Total Repair Cost. What Are My Options?
A drunk driver crashed into our detached garage 3 months ago. The driver contacted their insurance and we notified ours. We had a structural engineer look at it and their opinion was that a re-build was the only safe and practical option.
Their insurance offered $25k for a full release, and the estimated reconstruction cost is $60,000–$80,000. Our home insurance has already reached its coverage limit ($20k). We have not signed anything, nor cashed any of the checks from our home ins.
Our goal is to just have our garage back.
We are very unfamiliar with this whole process. I've never even had a fender-bender before. We just bought our first home last year. I am unclear if what their insurance is offering will be part of the subrogation, or if it stacks. Either way, we are left with a hefty amount to cover for someone else's mistake.
No one has hurt, other than our garage. Location: Virginia
Will an attorney be able to help with this? What are my next steps?
