Drunk Driver Hit Me I Was Found Liable
Location: Florida
I was in a parking lot on a cloudy night going home turning onto a street in the parking lot I looked both ways saw no car moved forward and then noticed a vehicle approaching fast (speeding for being in a parking lot) with no headlights on and I could hear he tried breaking but didn’t try to swerve out of the way and he hit me and car still went another possibly 20 feet further due to how fast he was going even tho another 10-15 feet ahead of him was a stop sign.
Cops were called they arrested him for DUI (he is underage but over 18) and this was all stated in the police report (police came to the conclusion he was at fault for the accident and Ik that insurance does not have to go with what the police say). Now insurance is calling me saying that I am 80% liable for the accident. We both have the same insurance.
What do I do?
Edit: the stretch of road had to be about around 100’ or less. Since it was in a parking lot speed limit is around 10-15 mph
Also they are handling both claims under one adjuster.
