Employer Asked For Severance Back After I Was Laid Off

Card image cap

I was laid off this week. During my meeting with HR, I asked about severance, but was told they only pay out unused paid leave as severance. We get 30 days of paid leave per year, available at the start of the year. I’ve only used about 14 days of paid leave for military training. However, I was informed I was in the negative 4.5 days (they prorated my leave to the date of layoff), and so I wouldn’t get any severance.

Then I get a wire transfer for an amount that could only be my full week’s pay plus my unused leave. I also get the following email from HR;

Hi —,

Hope you're well. I just wanted to drop you a note to let you know that we were unable to deduct the 4.5 vacation days from your final salary due to timings of the pay run and we would be really grateful if you could send us back the amount that has been overpaid.

I have requested the NET figure from [Finance department] and also the account details to send it to, and will follow up with this information so you have it.”

My question is do I have to pay the amount back? It’s more than $2k.
