Etsy Copyright Dispute, Agressive And Pushy Emails

Card image cap

Location: Canada
Hi, I filed a claim through etsy for 24 listings which all were selling my design that I had made back in 2019. Now one of the sellers is refusing to identify themselves via email and are threatening legal action tomorrow at 5pm pst. Etry removed the listings and nobody disputed it via a counter claim with etsy. They claim they have a design made in 2017 2 years before my design. I'm not well versed in this stuff and I was pretty angry that people were profiting from something I had made without ever getting in contact with me. From what I can see the sellers were selling my exact model, with easily identifiable tooling (3d strokes in software used, in this case zbrush) and landmarks on the models matching 1-1. Should I take this seriously or ignore him as it is very agressive throwing around that I owe them damages, money etc.

An example of their email 1: I emailed you earlier today regarding this matter and have not received a response.

I do not intend to involve Etsy further in this dispute, as Etsy has done nothing wrong. My concern is with your decision to report my design as stolen when I have evidence that my design was created in 2017, two years before you published your design on your website.

I take this allegation seriously, as it has the potential to damage my reputation and harm my business. I have documentation supporting the creation date of my design and am prepared to present that evidence in support of my position.

I have been assigned a case with the Oregon Small business Secretary of State who will assist me in this matter and I also I consulted and hired an attorney today regarding this matter and am prepared to pursue the legal remedies available to me concerning your report and to collect any and all resulting damages.

I am requesting that you withdraw your report to Etsy no later than Friday evening, October 16, 2026, and provide written confirmation that you have done so.

If the report has not been withdrawn by that deadline, I will consider proceeding with legal action directly against you to seek recovery of any applicable damages, legal fees, and other remedies available under the law.

I would prefer to resolve this matter promptly and professionally without further escalation. However, I am prepared to protect my rights, my work, and my business if necessary.

I look forward to your response.

You have stated that email is your preferred method of communication. If you would like mailed correspondence, please advise .

An example of their email 2: You have until tomorrow at 5pm to remove your report. If not, you will be required to attend a hearing in Federal court in Oregon where a warrant for your arrest will be issued if you fail to appear. My legal team has already contacted the RCMP this morning and they will now be involved and have you arrested for theft which is a felony. My proof has been sent and processed according to the laws that are in place. Not just some report to a 3rd party like you did where you are now liable for defamation and damages to my business. Up to you. You should do your work first and actually contact me before damaging my business and trying to steal my work. Maybe get an attorney involved before you cause damage to a business? Your illegal actions are very serious.

If you feel you are correct (which you are not), it is super easy to do, but you failed to do things legally and now will be held accountable for your illegal actions. There is no way you can see any “tool markings” from a file to a print. You just keep giving me more evidence to use against you. We actually downloaded your design from Thingiverse yesterday and compared files with my legal team’s forensic specialist. You are absolutely incorrect. While they may seem similar, you cannot actually know until you compare file to file and you did not do that. We did.

You can tell you are not very experienced and have little understanding how this works. I have been designing and doing this since 2013. You have no idea what you are doing and you just admitted this. I will be having my legal team contacting Thingiverse and cg trader and anyone else you associate with to notify them of your illegal actions.

I have already sent my design information in to the Oregon State Attorney's office and to my legal representatives who have already looked at all that and it shows you are incorrect and I will be moving forward on Monday to get damages (and for you to get some jail time) unless you remove your report by tomorrow at 5 pm PST.

You should have reached out to me first and asked for clarification before trying to steal my work and damaging my reputation and business. I understand that people like you who do not do as much designing for as long as I have don’t understand many things. But you have done everything wrong and you will be held accountable accordingly.

I will come after you for more than just money and damages. You will go to jail for a felony (also any international laws that you have committed which I will pursue) and you will have an international warrant which is enforceable by international law which I will make sure you are held to the fullest.

This is your final warning. I could have easily provided this information to you if you would have asked before causing damage to my business.

Tomorrow 5pm or I file Monday at 8am. You already owe me $5000 for me having to retain legal counsel. Keep your report in and that just goes up - especially being an international issue.
