Ex Defaulted On Rv Loan & Abandoned Property
Location: Tennessee
My ex-girlfriend and I purchased a house together in our early 20s. About 2 years later in 2021 she convinces me to cosign and buy an RV so she could save money on travel expenses as she was a travel nurse after she declined on getting the loan herself.
Turns out the RV was a plan to leave me, as she then proceeded to break up with me and got married to a man after having his baby all within a year of doing so. I guess that ended up not going too well for her, and in 2023 she calls me saying she has abandoned the RV in the state of Washington due to maintenance and damages being too high. I find this out by the payment on the RV being 30-days late and being called by the bank. I catch the payment up to reach out, and she simply states she is done.
I immediately take over payments, and hire a trucking company to bring the RV from Washington to Tennessee. They get out there, and it won't even start. I have to have it towed to the dealership in which they inform me due to her not changing the oil the engine had completely seized up and the RV is in one of the worst shapes they've ever seen, and in its current condition is only worth 10k. At the time I owed $78,000 still.
Unfortunately defaulting/bankruptcy isn't an option. I buy and sell real estate frequently as well as I purchase insurance agencies as a means to grow my agency. Essentially, any damages to my credit would be detrimental to my livelihood, and she knew this. In total over the course of 3 years I have put a little over $90,000 between payments, replacing the engine, insurance, renovations, etc.
I have all invoices, bank statements, payments to the insurance/bank, property tax receipts, etc.
I know enough personal information about her to hire a PI to track her down. I know she's living in Texas now. I also know she divorced the other man and abandoned her 1st baby in North Dakota then proceeded to move to Texas and have another baby. Unsure if she is married to him at this time, so there's a clear pattern of erratic behavior and neglect.
She's an RN so I know if a judge places a judgement on her, I would have arguments to garnish her wages and she wouldn't fall under the income threshold to avoid wage garnishments.
My questions are as follow:
1) Should I be seeking for damages across ALL $90,000? or should I simply be seeking half? As my name was on the loan, and technically makes me half responsible for the liabilities. I have proof thru emails that when we broke up I agreed to pay her $$$ to take her name off the deed of our home, and that as long as payments were made by the other party on our respective loans we would not have to refinance. We did this because the interest rates were those covid 2.89% on the home and 5.49% on the RV and both would have nearly doubled/tripled.
2) My overall fear here is if I sue her she will simply file Chapter 7 or 13 bankruptcy, and in the end whatever legal fees, attorney costs, etc. I accrue will simply also go down the drain. I mean. Is this even worth pursuing?
