Ex Sold A Joint-owned Vehicle In Cash, And The Vehicle Still Has A Lien From The Bank
Location: Florida
I co signed on a vehicle in 2022 with my now ex-girlfriend and I haven't spoken to her in 3 years(nasty breakup). Part of the agreement we had when we split was that she would make payments and keep the car. The vehicle is registered as "or" and the amount still owed is 14,500. Ive looked into all the ways I can get my name off of it but since there is a lien im stuck until its paid off.
I have been monitoring the payments on the banking website and she had been paying for years on time, never missing a payment. Well recently she has not made any payments and I found out from a former coworker(we used to work together) that she has sold the car. I'd presume it was a cash sale since she didnt use that money to pay off the loan. She has a history of drug use and could have sold it to fuel that.
So my question is what can I do about this? There is someone else driving around in a car with my name on the title and registration and if there is an accident or red light/parking/etc violations im on the hook for that. I assume that the loan is going to to just keep becoming more delinquent since it wasn't a legal sale and title transfer, so will the bank repossess it and I'll be clear? I understand in that scenario that my credit would take a hit and I'd still have to owe after an auction, but that looks like my best option. Thoughts?
