False Dui Arrest / Entry To Canada
Yesterday morning at 8am my husband was pulled over for driving over the speed limit (a few mph) on his way to an appointment with a mechanic 3 hours away in
Location: Kitsap county, WA state.
The officer accused him of drinking and he denied that because he has been completely sober since September.
He agreed to a FST thinking of course he will pass it. Officer said he did not pass it.
My husband asked for a breathalyzer and the officer said he didn’t have one and arrested him. He was not given any traffic tickets. He has zero prior charges or convictions and a squeaky clean traffic and criminal record.
Took him to the hospital for a blood test, car was towed and he was booked into jail. They did a urine test in which everything came back negative. He asked 4 different people for a breathalyzer at the jail and they all said they don’t do those there.
He sat in jail for 26 hours waiting on his arraignment, then he was released and told the arraignment was cancelled and they said no charges yet/waiting on the blood test. Both the arresting officer and another one at the jail said those results could take about a year to get. Not sure if that was snark.
We have our 10 year wedding anniversary planned as a trip to Canada June 15th. I know Canada is super strict with DUI entry, but a google search shows that you may not even be able to enter the country with a DUI arrest even without conviction.
Does anyone know if that’s true? That’s our biggest concern right now as we’d have to cancel our accomodations. He is confident that the blood test won’t show anything. Do we need to get a lawyer?
