Fender Bender Turns Into Aggrevated Assault

Last week, I was in motion and entered into the left hand turn lane, moving about 15mph and slowing down to come to a stop at the light. A car in the lane to my right which was stopped and waiting at the light made a split second decision to enter my lane without a turn signal. My passenger side front bumper made contact with their driver side fender behind their headlight making a dent; The driver slammed on their brakes and my vehicle drug along their fender and left a swipe down the side. The other driver and I both pointed over towards a restaurant parking lot, in which the other driver floored it and drug the side of their vehicle along side mine and now put a scrape down the side of their vehicle extending beyond the initial damage.

The other driver exited their vehicle and was viewing the damage on their vehicle, and I stepped out of my vehicle and walked to view the passenger side of my vehicle when the driver approached me angrily screaming "How are you going to pay for hitting my car?". I could tell the guy was very upset, and I tried to calmly explain to him that I have insurance, and that we needed to file a police report and insurance will handle it. I asked if he or anyone else in the vehicle was hurt, in which he just looked at me with a blank stare. I told him that I wanted to snap some pics of the damage on both vehicles, and I proceeded around my vehicle towards the damaged side of his.

I stopped to the side of his vehicle and started to pull out my phone when I was blindsided by a punch near my ear. It caught me off guard and I lost my balance and fell over onto the pavement. I immediately rolled over onto my back when the guy started kicking me and several other random people who were nearby also ran near us. I tried to get to my feet and one random person kept screaming in my face to "Stay the F down" and was pushing me. I realized around that point that I could not move my left leg, and it had gone completely numb. The driver stepped over me and started to bend down and punch me in the stomach when I grabbed both his legs and pulled myself under him with my good leg lifted ready to try to shield myself from a punch and prevent him from kicking me. I didn't know what the right thing to do after that moment, but after I had his legs locked together for a bit, I kept telling him that he can just take my insurance info if he would let me get up and get back to my vehicle. The guy let me pull myself up and I hopped back to my vehicle on one leg, with him following by my side threatening to attack me again if I didn't produce insurance info. I was able to lean in on my seat, the bad leg hanging out of the vehicle, and I got into my center console and dug the insurance card. This guy had a video chat open and was waving my insurance card in front of his phone screen screaming at someone when I heard the sirens from an incoming police vehicle. Two cruisers flew in and the other driver retreated to his vehicle. One officer approached me and asked what was going on. I explained quickly the accident details, before telling the officer that I had been attacked and that I had no feeling in my leg and couldn't put any weight on it.

The officers took their report, I signed a single paper stating that I wished to file charges, and I was handed a small slip of note paper with the officers badge number and the police report number. The EMTs stretchered me into the back of the ambulance and evaluated stating that there was no bruising or swelling, just a skinned elbow and my complaints of leg pain. The other driver made a huge scene with the officers after I was in the ambulance and said that all 5 of his passengers had been hurt in the accident. His passengers were all evaluated by the EMTs on scene and found to be injury free. The police waited for a relative of mine to arrive and leave in my vehicle before allowing the other driver to leave the scene. He was not arrested.

I was taken to the nearest hospital and x-rays done on my hip and leg. They found that I had fractured my hip, and I was rushed to a larger hospital for emergency surgery and now have implants holding my hip together. I will be out of work for the next couple months and the medical bills are going to keep piling up.

Whats my best course of action and best path to try and get something out of this to help cover the medical bills?

For the TLDR's: Minor Accident, other driver failed to yield to oncoming traffic. We pulled over in a parking lot and driver of other vehicle assaulted me in a fit of rage. The attack caused me to fall and fracture my hip, requiring emergency surgery, and will need months of time off work and lots of medical bills. The officers did not arrest the other driver, and all did was sign a paper asking to file charges and I was given was a piece of note paper with the report # on it. How do I proceed and try to get my bills covered?
