Florida Condo Law Question
Location: Boca Raton. I live on the ocean in a 10 unit condominium. Our three member board has never experienced a hurricane and has decided to forgo our master Windstorm for this season in order to save money.
They’re in breach of their fiduciary responsibility to protect the building .
Today’s afternoon run of the GFS forecasting Model has a cat five coming from under Cuba and striking Fort Lauderdale and going up the coast. For people reading this that doesn’t mean this is going to come true. It’s just one run and it means people need to pay attention.
My question is this, if it were to come true and our condominium destroyed, can we personally sue the directors of the condominium who are in breach of their fiduciary responsibility? It’s my opinion that their D&O insurance does not protect them in this case.
We would hate to have to do this, but it would be our only option as we are not insured if the roof were to come off and the place were to be destroyed.
Any attorneys out there that could chime in I would greatly appreciate it.
