Fmla Leave Law Won’t Cover First Week Of Organ Donation Surgery, Nys Labor Law Says Otherwise

Hey! I’m seeing if I can get some clarification on this matter. I’ll keep the situation brief - my younger sister has recently gone into End-Stage Renal Disease and thankfully I’m a viable match for her, the hospital had confirmed late last week that the transplant will take place at the end of the month. I am a NYS resident working at a NYS registered LLC, which utilizes a third party provider for extended/medical leave, or at least for the request process they do. I filled out the form today to request 3 weeks off, and the returned estimate I received stated that the first week in which I will be on leave will be unpaid. I did some research, and I found that NYS Labor Law Chapter 31, Article 7, Section 202-B states “Any employee of the state of New York shall be allowed up to…thirty days paid leave to serve as an organ donor.” Should I be warranted that first week of pay by this law, if not, why would that be the case? I’m also not sure if they will switch this case to NY PFL. Even though what I received back so far was only an estimate, I want to get ahead of the game just in case.
