Forced Upgrading Of Hvac In Commercial Space
Location: Portland OR
Hello, commercial business tenant here. We were renting a 20% portion of a larger commercial warehouse that is 40+ years old and not well maintained. All existing fixtures including HVAC were of the same age beyond what we paid to upgrade.
Building is sold at the end of 2025. New owners go about extensive building upgrade including replacing heating units. They gave me no option to replace, maintain or upgrade on our own. New owners are now demanding we pay for the upgraded system in full.
Our lease only states that we are to "maintain the systems" I had been paying already to maintain the units in their original existence (crappy 40+ year old).
If I had been given the opportunity to replace myself I would have sought lower bids or just continued to maintain in their original condition.
New owners gave no notice to fix it the prior costs to doing so, only came in and replaced then doing the other units.
Should we be forced to pay the full bill?
