Given 48hrs To Move Out

Card image cap

Location: Pensacola, FL.

I was just told I have two days to move out of my current residence. I’m trying to understand what my rights are.

I moved into this house about nine months ago with my partner. There is no written lease. The house is owned by a man who lives directly across the street. Rent is paid monthly from my partner directly to him. I receive mail here, live here full time, and this is my primary residence.

Landlord (LL) is married to partner’s coworker, which is how partner knows him. Before I moved in, the house was filled with a large amount of the landlord’s stuff. I'm NOT a doctor, but think hoarder house. My partner was instructed by him to move any/all belongings into one bedroom, which she did before I moved in. He cleaned nothing. My partner made it so the house was walkable. Then slowly started prettying it up and making it livable.

Several months into living in this house, partner’s coworker (yes, that one), her son, and a friend came over and began *throwing out* and moving/rearranging large amounts of LL's property. I'm talking putting items directly into trash bins. I refused to participate. Messing with the belongings of a hoarder is a classic fuck no. So LL finds out about the mass exodus. My partner and the other two appeared genuinely freaked out and seemed quite worried, which I took note of. Somehow coworker/wife of LL chills him out. We thought. This is wild but here we are: LL went through our trash bins on trash day. Like a few days after the house had been "cleaned." Dumpster dive style. LL confronted partner about two very specific items he believed were thrown away. I was later confronted by the landlord as well, during which he became verbally aggressive and insulting toward me. I calmly denied throwing away his belongings, which is the truth, and I avoided further interaction with him after that because his language and behavior was unhinged.

After that incident, I heard nothing further about the trash or any issues for about three months. My partner and I were feeling good, but it was understood that I would eventually be moving out of state, though no specific date was ever agreed upon and nothing was put in writing.

On January 30th around 9pm, my partner told me that LL said I need to be out of the house by February 1st. I've not received any notice directly from the landlord. I have not received any written notice, mailed notice, eviction notice, or court paperwork. I have not damaged the property, missed rent, or engaged in any illegal or violent behavior. I am willing to move out, but I have not had time to pack, arrange a U-Haul, or secure another place to stay. I do not have anywhere to go immediately. I was effectively given less than 48hr notice.

I want to leave, but I want to do so legally and without losing my belongings or being forced out improperly. Given that there is no lease and no written notice, I am trying to understand whether this demand to vacate in two days is legal under Florida law?
