Going To Court-ordered Rehab When Sober
Location: Snohomish County, WA State
I went to a court-ordered substance use evaluation today. I was ordered to get this evaluation as part of a plea bargain for an assault charge. I was told that I have to do intensive outpatient care and attend four meetings a week. These will take place during work. I am on a probationary period for a highly competitive job and will be let go if I miss this much work. The kicker: I was told that I had to do intensive outpatient because of my meth use.
I do not use meth. The opposing party on the assault charge claimed that I was a meth user to spite me, along with some other awful lies sprinkled in. Soon after that claim, I got a hair follicle test to protect myself, and it of course showed that I had not used meth. There was only a claim that was made, there was never any follow up to substantiate if it was true, unless we're counting this fiasco here.
The only drug I use is nicotine. I had to take a urinalysis, and the urinalysis will reflect that I don’t use any other drugs. I told the attending counselor that I only use nicotine, that I don’t use meth, that I have a hair follicle test showing that the meth claim was fabricated, and that I will lose my job if I have to do intensive outpatient care. He just told me I should be honest with my employer and tell them that I have to go to rehab. I did admit to a kratom habit that I kicked earlier in the year, but that’s been over with for some time now, and it wasn’t even mentioned as why I had to do intensive outpatient.
Do I have any legal recourse here? Can I still contact my past public defender about this? I mean, my urinalysis is going to come back clean, I really hope there’s something I can do with that. I was homeless for a while, and I really don’t want to go back to living on the streets, but that's how things could pan out if I lose this job. It was one of the worst experiences in my life, I’ve worked too hard to escape that awfulness and now I'm afraid I'm getting sent back.
Ninja edit: I should mention, this isn't yet set in stone. The counselor said that's what he is leaning towards, but the official orders will come out by the end of the week.
