Next Of Kin Issues With Notarization Of Medical Record Release.

Location: Texas

Hello everyone.

My grandmother had a life insurance policy for me, however she passed away two months too soon for the policy to be fully in effect and the company told me they'd need to see medical records to make sure her death was natural and nothing we didn't tell them about. It was, she died of old age, no complications.

I've been fighting with this company for five months. I am now at the point where I have to get a paper notarized for medical record release. However, it says I need to complete a next-of-kin form. They mailed me the document a week ago and I was busy sorting out my new job to get to it. I assumed since they had me wait for so long they'd keep my file in check and let me get to it when I do.

But, I just got a email saying I only have five more days before they close out this request. But after reading it, I'm not sure if I can even sign it? Granted I can go get a notary to assist easily, but I'm not necessarily next of kin, I'm her granddaughter. And I have no contact with her next of kin, being her two sons, they both hate me for even receiving the policy over them and they went no contact with me after I refused to agree to give them more money than I already have.

The form says the following (the only important part I guess):

  1. I am requesting this information based on my status as (check one):

- a duly appointed attorney in fact pursuant to a Power of Attorney, a copy of which is attached, authorizing me to obtain copies of medical records.

- the duly appointed executor or administrator of the estate of the above individual and a copy of the Letters Testamentary or Order appointing administrator is attached.

- guardian of the estate of the above named individual and the letters of guardship are attached.

- custodial parent of the above named child and a copy of the custody agreement is attached.

- personal representative of the estate of the above named individual, who is deceased, and because no court proceeding is necessary or has been commenced to administer an estate, I provide proof that I am next of kin by attaching documentation supporting such status.

Can I still sign it?

I was not the POA. My uncle was. And there is just no possible way for me to be in contact with either of these people.
