Guy Suing Me Trying To Disqualify My Law Firm Because They Did His Will.
Location: Alberta, Canada. There’s a guy who has been harassing me for years who is now suing me over a made up issue. My lawyers aren’t concerned about winning for myriad reasons. The problem is he doesn’t seem to want to actually proceed to the point of debating the merits of the case. Instead he’s now filed to get my lawyers kicked off because their firm did his will.
His filing doesn’t even say it’s a will - it says it’s a “closely related matter”, which it is not. Apparently my lawyer had to explain the difference between a business conflict and a legal conflict to his. They brought it up with management who agreed it’s not an issue. They told him it’s firewalled, the lawyer who did his will is the only person who can access his file, and confirmed with IT that nobody has touched his file.
Due to the language in their retainer agreements my lawyers aren’t worried, but I’m really nervous. This guy, in my view, frankly isn’t stable. He sent 70+ page letters to me at my job, even though he had my home address. He’s also rich, so part of me thinks he just wants to bleed me out. Meanwhile, we had advised we were doing a summary dismissal application. Seems like he is blocking that from happening.
My question: can he really disqualify them for this?
He also apparently tried to file a law society complaint but the law society retracted their email to my lawyer.
EDIT: I should note I was already a client of this firm when they did his will. I had them handle the sale of a home two years before he engaged them.
