Hire Plumber To Replace Water Heater. Bought Tools On My Credit Card And Kept Them.

I hired a plumber to replace my water heater. 80+ 5 star reviews on Google. Seems like a good company. He said I would pay him for labor and I would pay the store directly for the materials. I agreed. He went to the store and got all the stuff. The pro desk called for my credit card information.

I told the plumber I wanted a copy of the receipt from the store for my records. He didn't give it to me until the very end. I was busy with other things so I didn't look over it before he left (yes my fault). Once I did I realized he bought a prybar, a screwdriver set, and a dolly/hand truck and that went on my credit card. It was roughly $140 of tools. At no point did we discuss buying tools. Also we own all the things he bought so if he needed it I could have lent them to him. He kept all the tools I purchased.

In my eyes materials would be the water heater, pipes, fittings, and other consumables not tools.

I have sent him a message stating that I want the tools but no reply. Trying to figure out next steps. Should I take him to small claims court? Is that the correct legal path?
