Hoa Gave Us A Violation Notice About Vegetable Garden Plants
I am a tenant in a condo in Location: Northern Virginia.
I have lived in this unit for 4 years now, and i have maintained a garden on the patio every year.
Recently, my landlord reached out and told us that the Condo's HOA has sent them a violation notice about our vegetable garden plants and gave us a little over a week to remove everything.
This is very devastating for me as i really enjoy growing things that i can use or use and i have spent a lot of money getting this garden to where it is today. This HOA community does not have a community garden. However, there are some other violations that i see on the daily by other people living here.
My first example is that there is a rule against leaving a vehicle in the same spot for longer than a period of 7 days and all cars must have current inspections/tags... There are MULTIPLE vehicles that have not moved in months, and even more that have not gone through the yearly safety inspections and some with tags that expired a couple years ago.
My second example is that there are a few other units who also have plants on their porch, and 1 neighbor has even grown his own fig tree in the bed in front of his unit! I will say they dont have as many as i do, but in the write-up, they call out removing all of my planters, which are not permanent structures. in total quantity, i have 2 greenstalk planters, 2 earth box planters and 2 hanging baskets called out here.
Would this be a case for selective enforcement? Also if they are doing regular inspections, why am i just not getting a violation 4 years into this? Any advice about this is appreciated.
