Hospital Gave Me Another Patients Test Results And Seem To Have Lost Mine

In Sept 2024 I had a procedure to remove my fallopian tubes. After the procedure, they dissect the tubes and examine them for any abnormalities or issues and write a report about the findings. At the time I had skimmed through mine to see what their status was and research what it meant. I have always had reproductive health struggles so this was important to me.

Earlier this year I decide to read the report again and realized that the report stated several times that the fallopian tubes in question were not mine and were actually from a patient with a last name with the same first 3 letters as mine. It was marked as for me but specifically said in the description "received in tube labeled with patients name: ________" and was another persons name. It said this for 3 different samples, all marked with the same other persons name.

As soon as I noticed in Feb of this year, I contacted the OBGYN office through their MyChart portal and let them know I received the wrong test results for somebody else and never received my own results. They told me they would look into it and get them to me as soon as possible. They never contacted me back. In late March I contacted them again and asked about an update, requested somebody working on the issue to contact me, and let them know I was very worried about what may have been in my results that has now been missed, or if there was even any testing at all. They simply responded that they had let several people know and it was "being investigated" and they would contact me when they hears back from the investigators.

Once again I never heard anything back. Today I tried to log into MyChart to message them again, and received an error notifcation letting me know that they had disabled my account. My account was the only place to see the paperwork that showed the tubes weren't mine, and to contact them directly. I managed to save the file of the paperwork before they kicked me out so I have a copy but no access into any of my health information now.

I'm extremely worried about not having that confirmation that my tubes were even removed, and especially not knowing what state they were in. I'm also worried about the possibility of somebody else getting my results and not their own as well.

I will be trying to reach out to their office, but is there anything legally I can pursue against them, and who could I be reaching out to for support?
