How Can I Quickly Get My Daughter From The Stepmom If Her Dad Gets Deployed?

My location: Georgia

Their location: Florida

My daughter's father and I have joint legal custody, however he has primary physical custody right now, so she mainly lives with her dad and stepmom. I get weekend/holiday visitation. There's been a really nasty custody case, and there are some very questionable things going on, but I ran out of money and ended up settling in mediation. I am saving up to take them to court to get her back next year. During mediation I asked if we could say something about me getting her if he goes on deployment, and the attourney said that wouldn't make sense for her to come with me for several months and then go back because of changing schools and stuff. In hindsight I wish I had asked if there could be terms that she would come back with me indefinitely and that if he wanted to renegotiate when he gets back we could do it then.

My daughter told me last weekend that her dad is getting deployed. I asked him and he said that he told her he "might" be getting deployed. He denies knowing for sure and says that he wouldn't be allowed to tell anyone anyway and won't know until last minute. I told her that if he does, our daughter needs to come with me instead of just being with the stepmom for months on end. He said, "yeah, that's not gonna happen." Btw I have no history of drug use or legal trouble or anything like that, she was with me until she was 8 and we made the mutual decision for her to go with him due to behavioral and school performance issues; I also have a steady income and own a house, so there's no reason for her not to come with me.

I am going to be getting back with my attorney this week. I don't really trust her anymore because of us not addressing deployment in the first place, but she's the only one I can afford in the area so I wanted to pick your brains for ideas and thoughts about this before I come to her with the issue. How can I quickly make things so that I get her instead of her staying with the stepmom if he gets deployed? TIA!
