No Deadline In Separation Agreement And Release?

Location: California, USA

Hi All,

During Summer 2026, me and my boss were fired for “performance issues” over something outside of our control. For the sake of confidentiality, I will omit those details.

Basically, I was given a Separation Agreement and Release while being terminated by HR. I signed the agreement the following month but ultimately decided not to send it since I believe I had a really strong chance at suing since I documented everything, including pictures and texts from employees prior to the event.

Fast forward to today (120+ days later), I have the signed document laying around that I never sent. There is no deadline written in it, except for vague language stating that I acknowledged I had AT LEAST 45 days to review. There was no “sign by” or “return date.” They did not verbally state one either.

Basically, if the date was not specified, is it worth sending over? I’m over the “I should sue” mindset and decided to drop it, since I already received a job offer and promotion elsewhere. I viewed the termination as a blessing in disguise since I was burn out and received vacation pay and UI pay.

I had a senior position in the company and the Separation Agreement states that I could be asked to cooperate in legal matters if I signed (I was involved in many legal aspects while at the company) so I suppose not signing it at least provides minor protection.

In summary: I would receive a severance pay if they accept. If they don’t, I’m OK.

Thanks all!
