How To Approach Replacing A Fence Between Properties.
location: Illinois
we recently moved and the back yard has an old beat up chain link fence around it now. both owners (we are on the corner so 2 neighbors) say the fence section is their property.
the owner behind us doesn't care what we do with the fence and is all on board for us tearing out the chain link and installing a privacy fence. he is only there 1 week a month anyway and has another house in Minnesota.
the other neighbor has a privacy fence on the inside of her chain link. claims both are hers. I would really love to get rid of the chain link and build off of her privacy, but I'm ok with it if we just leave the chain link on that side since it still has a privacy section.
my worry is about the neighbor behind us. he doesn't care what we do, but I'm worried that if they decide to sell a new owner may come in and decide that the fence is theirs and tear the whole thing down. should I get a survey done and move the fence onto our property line (if it is not already)? should I get some sort of document with the current owner and file with the county that we were permitted to build on their line?
