I Got Arrested For Dv A Year Ago And Afraid It May Cause Me To Lose My Job.

Location: CALIFORNIA. So a year ago I was in a relationship and long story short, an argument escalated into a physical fight. He slapped me, so I hit back. We fought pretty badly and he mainly just pulled my hair and dragged me or shoved me into things so I didn’t really have many bruises besides on my shoulders and legs. I scratched him up pretty badly. Someone called the cops and they said they needed to take one of us in, since he had scratches and I looked untouched I was the one to go in. I explained to them that he hit me first but they didn’t care.

Well, I landed in jail for a few days but luckily they were my days off. I have been with this company for years, they love me and I’ve won employee of the month 2 years in a row. However I do have to renew my license for my caregiving job every year and that requires a yearly background Check. So my job pretty much called me up a few days ago and basically said that they weren’t able to renew my license due to my background check. They said that they weren’t sure what exactly was on my background check but that I’ll be able to continue working, I just had to go in the same day and do my fingerprinting and then we would have to wait for my fingerprinting to go through. In the meantime they allowed me to work without my license.

It’s been a few days now and they haven’t received my results and I already know that it’s for the few nights in jail. No charges were pressed and I wasn’t convicted. I got sent a letter in the mail saying that my arrest wouldn’t be labeled as an arrest and instead would be labeled a detention, which I’m guessing is less severe. It doesn’t pop up on a regular background check however it does show up on fingerprinting just because it’s a bit more thorough.

Anyways, I’m pretty worried that I may lose my job. It’s taking forever to get the results and I’m even more nervous. If anyone knows anything about the law can you guys please give me advice and tell me if this will affect my employment? The relationship ended right after that and I’m not in contact with him. From what I know the officer told me that my ex had begged them not to take me in, but of course in California they have to take someone in just for safety and liability reasons, completely understandable but dang. I have a young son and work full time and if I lose this job I’m done for.
