I'm Being Sued For My Ex-husband's Car Loan. Help Please!
Location: Massachusetts
I'll try to be succinct. In 2008 my then husband brought home an expensive newish car. I was not there when he bought it and it was never in my name. We separated in 2010 and he continued to drive the car. We were divorced in 2013. I filed bankruptcy in 2014 to get out from under all the marital debt.
Fast forward to last week and I get a call from a law firm saying that I'm being sued for $13k because the loan defaulted. I tried to explain that I'm not responsible for the debt. They said that it was my responsibility because we were married at the time of the loan. They also said it wasn't discharged in my bankruptcy because the loan was still current at that time. They stated that the last payment was made in 2020. The car never showed up on my credit report and I have financed a house and two cars since 2017.
They are sending a process service to my job with paperwork. How can a car loan go for that many years? Will I actually have to pay? I'm planning on hiring a lawyer but I don't have any real documentation to give them. Do I have to wait to be served to get the information about the loan/case? I'm panicking at work right now, any info would be very appreciated. Thank you.
