I’m Not Sure What To Do

So i was walking my dog one quiet morning when a guy in a Chevy truck plowed through me and my dog. I blacked out, my dog died

I was taken by ambulance to the hospital. One broken wrist (my dominant hand) was broken requiring plates and screws), my other shoulder dislocated and popped back in so torn tendons requiring surgery (end of month). My face ate some pavement (facial scarring), torn earlobe, etc. i spent 4 days in the hospital

I have PTSD so my dog was emotional support so I’m not going too well.

The driver has state minimums. The police report said he’s at fault. His insurance company accepts he is at fault.

So his insurance is offering to release the whole policy $30K but if i accept, i can’t sue him. So far the medical bill I’ve received is $275K. I can choose not to accept but if i sue him, his insurance company will represent him. I have USAA insurance and they’ve always been good to me. I have uninsured motorist of 300 but it i get a lawyer, that is 33% they get which leaves me much less for my bills and any long term care, pain and suffering… that is if my insurance company gives me the whole thing

Seems lawyers are not encouraging me suing him directly. How can he have taken my beloved pet, put me in such pain and all he’s accountable for is a measly $30K policy because his assets might be protected by the state while I’m such a wreck. The lawyers say it’s not about fairness but what’s legal and his policy covers him up to that amount in the case of accidents

So i want him to pay (feel a fraction of the pain I’m dealing with). But i dont know if i can. Help me understand why i cant sue his behind off even if its a judgment because he played stupid games with low insurance coverage?
