My Underage Brother Rode With A Drunk Driver Who Wrecked. No Responsibility, No Reports Being Enforced. Help.

Location: WV, USA

My brother (M19) was in a vehicle wreck 3/23 with a drunk driver. My brother is not a licensed motorist, his friend (M23) who was drunk was the one driving. My brother asked him to take him home several times prior to him getting drunk and his friend refused. My brother’s phone died and he couldn’t call us.

The guy he was riding with wasn’t arrested on the spot due to “injuries” and a warrant was never issued from the police dept. the “friend” is walking free injury free currently.

My brothers arm was smashed to hell, it broke in several places just from his shoulder to elbow and he was in the hospital for 3 days + surgery. His road to recovery is going to be extremely long with physical therapy and doctors visits.

His friend did not report it to his car insurance and so far police are not enforcing that. We live in a bullshit small town. My parents tried to call a lawyer today and they said that my parents should report it to THEIR car insurance for uninsured motorist?

This makes no sense to me.

What can we do to get rid of this liability?

ETA: the driver has insurance but won’t give the info to anyone and the cops failed to get it. We don’t know who it’s through. My parents don’t feel like they should be liable (reporting it insurance raises their premium).
