I Was In An Accident In December, Other Person Was At Fault But Their Insurance Has Still Not Agreed To Fix My Car. I Do Have A Lawyer.

I was in an accident back in December and the trooper that investigated it ruled the other person at fault. It was dark and the other driver didn’t have their lights on so I didn’t see them until it was too late.

I secured a lawyer immediately who advised me to seek medical attention. I went through about 8 weeks of chiropractor visits which finally ended last week, my lawyer said they would submit the paperwork to State Farm (other drivers insurance)

This is where it gets complicated. State Farm initially accepted liability and they were ready to have me send my car to a shop, then they realized they accidentally had two claims open for me. They closed out one of them but then they came back and said my claim was denied because their other driver was at fault. However, the latest I heard two weeks ago was they are still investigating.

I spoke to my lawyer after they said the claim was denied and he said he’s hoping they come back and say they’ll cover 70% of the vehicle repairs, and that even though the other driver was at fault he suggested that I still should have seen them at last minute.

I‘m at a loss, how can this happen when the state trooper said the other driver is at fault?

Do I need to look for a new lawyer? I just don’t understand how my car can still be sitting in my driveway with a messed up wheel, inoperable since December when the other person was at fault.
