Local Gym Used A Photo Of Me In An Ad Without Telling Me

I’ve been going to the same gym for about a year. A few months ago one of the employees took a photo of me after a class because they were posting pictures from that day on Instagram. I knew about that and didn’t care.

Yesterday a coworker sent me a picture of a bus stop ad for the gym and I’m literally the main person in it. Same photo, except they cropped everyone else out and put their logo and some text over it. I also found the same ad running on Facebook.

I never agreed to be in advertising and as far as I remember the only thing I signed was the normal membership agreement. I asked the manager about it and he basically said that because the picture was taken inside the gym they can use it.

I’m not trying to make a huge thing out of this, I just really don’t like my face being used to sell memberships without anyone asking me.

Can they actually do this because I’m a member, or would they need some kind of separate permission to use my image in an advertisement?
