Location: Fl, Usa. Got Rear Ended In A Fender Bender, At Fault Insurance Does Not Want To Pay
Location: Melbourne, FL, USA. My daughter was driving in Melbourne, FL and was rear ended when stopping for a yellow traffic light, and a 17 year old driver whipped out from the lane he was in, into her lane, accelerated into the yellow light, realized too late my daughter was not doing likewise, and rear ended her car.
Honestly, no one was hut and the car was still drivable, BUT, her rear fender needs to be replaced along with a tail-light. No biggie but I don't feel I should pay for it. The damages will probably come out to round $2000. The dude's dad showed up to the scene (a lawyer) talked to the cops, didn't say anything to my daughter, and now the driver's insurance does not want to pay for the repair because they say the "stories don't match up" between the two drivers "and there is no dash cam footage to prove who is right." I feel one car rear ending another makes it pretty clear, but my daughter had recently changed lanes before slowing down so that is their point of contention. The police report is not yet available, so the insurance company's position may change once it does become available.
So, if the at-fault insurance company maintains they will not pay, or offers a sum too low to actually address the problem, what do I do? The amount will be a small-claims amount, do I take the driver to small claim's court? The Insurance company? Do I find an ambulance chaser and turn them loose on the situation? What advice would you give?
