Ma – Vehicle With Recurring Defects, 68 Days In Service, Dealer Offering Downgrade Or Higher Price
Location: Massachusetts.
Purchased a 2022 BMW X7 in March 2025 (~$50k). Within the first few weeks of ownership, the vehicle began exhibiting issues (including early signs of water intrusion and electrical irregularities).
When I raised these concerns with the dealer within the first ~3 weeks, I was advised to purchase an extended warranty (approximately $7k), which I did.
Since purchase:
- Vehicle has been in service approximately 68 days across multiple repair attempts
- Issues persist after repairs (including ongoing water intrusion)
- There is evidence suggesting similar issues prior to sale
Additional facts:
- Extended warranty (~$7k) was purchased at recommendation of the dealer shortly after raising initial concerns about various signs of issues.
- Current loan payoff is approximately $40k
- Estimated current market value is mid-$30k range
Dealer response:
- Took over 3 months to present any structured resolution
- Multiple missed timelines and required repeated follow-up
- Proposed options:
- Base model X7 at ~$50k (lower specification than original purchase), OR
- Comparable/higher-spec X7 at ~$60k (no discount)
Dealer has not offered a full repurchase or equivalent replacement.
Questions:
Does this situation meet criteria for Massachusetts lemon law or other consumer protection?
Does the timing of the extended warranty recommendation (after initial issues were raised) have any legal significance?
Are the dealer’s proposed remedies typically considered sufficient?
Is pursuing a formal demand (e.g., Chapter 93A) appropriate at this stage?
Looking for guidance on legal standing and typical remedies in MA.
