Manager Keeps Pressuring Me About A Medically Approved Accommodation (feeding Tube). Do I Have A Case?
Location: New York
I (21F) have a medical condition that requires me to use a feeding tube during my shifts. The tube/pump is under my clothing, and I carry a small backpack with the pump. Occasionally (rarely, a few times total in about 4 years), it alerts/beeps and I step away briefly (usually under a minute) to fix it.
When I was hired, I disclosed this and provided medical documentation. My accommodation was approved, and HR recently reaffirmed that it is valid and not an issue.
After a recent incident where my pump beeped briefly and I stepped away immediately, my (new) manager:
Sent me an email about “disruptions on the floor” and said I should complete what I need before my shift or in designated areas.
Has since made comments like asking if I “need another break already” when I step away. I do not step away for my pp and each time he made comments I was going to the printer or the restroom.
Pulled me aside and asked me to explain how the device works and how often it would “interrupt work.”
Sent a follow-up email stating he understands HR “may not be able to change anything,” but that the situation is “not ideal for team workflow” and that I should be mindful of disruptions.
(All emails are posted on my profile, I can’t add images here I noticed)
HR has already confirmed my accommodation is appropriate and that I did nothing wrong. HR said they’d talk to him again, but that was basically it. I also briefly spoke with an employment lawyer, who advised me to document everything and said this could become actionable if it continues.
At this point, I’m not sure if this is just an uncomfortable management style I should ignore, or if this is something that could actually rise to a legal issue. Do I potentially have a case here if it keeps going, or is this still within the realm of what an employer is allowed to do?
I’m not trying to rush into a lawsuit, just trying to understand where the line is and how to handle this appropriately. I don’t want to risk my job; I do genuinely enjoy it.
